Classification

With all the current discussion on the mandatory filter and censorship I've been looking breifly into current law in regards to classification of material and what entails infringement of these classification legislation. So, in NSW, the current legislation appears to state that it is illegal to import, sell or distribute X 18+ and RC (refused classification) material (including unclassified material that would probably be rated RC if rated). This is common across Australia except in ACT and NT where X 18+ can be legally hired and sold except in prescribed areas.

Possession however is where I'm confused. If we restrict this discussion to RC material, it would appear that it's legal to possess RC material as long as it's not publically displayed and not accessible to minors. You can't publically exhibit RC material, but there doesn't seem to be any restrictions, other than having minors present during private viewing. This would seem to indicate that while it's illegal to buy, sell or distribute RC material, it's legal to view it privately.

The same is actually present in the laws regarding computer games. World of warcraft is interesting actually because it's currently unclassified (even though it wouldn't be rated higher than MA15+). According to NSW legislation:

A person must not sell or publicly demonstrate:
(a) a computer game classified RC, or
(b) an unclassified computer game.

But there appears to be no laws in regard to possesion/use other than keeping it out of reach of minors.

Obviously you can't physically import anything that is refused classification, or is unclassified and likely to be refused classification because customs are well within their right to seize the material, so I suppose it all comes down to whether downloading (ignoring international copyright law), or purchasing overseas/downloading is considered importing. Clarification in regards to whether even using the Internet to access international websites is considered importing would be good to know as well.

I'm just not sure how to find this information.

Looks like my internet is still screwed. They locked the line to ADSL1 after which it synced at 8000/800 (pretty much full ADSL1 speeds) but this afternoon I've just checked it out and it's resynced at 2700/32 (slower than dialup uploads ftw). So, more wasting credit talking to Internode.

I was showing a guy from another uni how to use the instrument with one of my colleagues today and after he prepared all of his samples we went for lunch, during which I had an extremely nice mastercard lady tell me that someone was currently trying to fraudulently use my credit card. Luckily they were trying to spend $2500 on a credit card which maxes out at $2000. They got away with $300 I think, but my cards now blocked and that's a pain in the arse. I currently pay my insurance, internet and electricity on the card so I'm going to have to change that, and it also means I don't have that financial buffer if I need it. The new one will hopefully come through in a week, and I don't think I have any bills which are due in this time, otherwise I'm going to get some interesting phone calls.

After working later than I expected to I walk out to my car and there's a malnourished kitten, probably less than a year old (medium sized) meowing underneath my car. After shooing it out from under my car it won't leave me alone. After 5 minutes of wondering whether I should or shouldn't take it home and then to the RSPCA I figure due to it's willingness to be near people that it's used to people so I leave it alone figuring it just got caught in the rain and will head off home. While driving my friend home around midnight I drove past the Uni carpark and it was still there. Attempted to pick it up but it seemed to want to stay where it was even though its obviously hungry and such, so I just had to leave it there. I suppose I'll check if it's still there in the morning and if it is I'll take it to the RSPCA then. I don't have any food that it could eat, and there was water on the ground anyway, so hopefully it'll be ok.

Anyway, I should go to bed, I have to be into uni at 10 again tomorrow.
